Prenuptial Agreements

One decision may be to enter into a prenuptial agreement to protect your assets. We understand that discussions surrounding the protection of a person’s assets and financial rights can be challenging just before marriage, but needed nevertheless. A prenuptial agreement defines certain terms of the marriage, establishes property, and outlines what will happen in the event of a divorce.

Post-nuptial Agreements
Post-nuptial agreements are similar to prenuptial agreements except that they are signed after marriage. Under Texas, all property acquired during the marriage is considered community property and divided equally, unless deemed otherwise by a Court. Couples typically enter into a post-nuptial agreement to exchange all or some of their community property between themselves in the event of divorce or death. The agreement becomes effective immediately after its executed.
