Legally Guided Surrogacy

Legally guided surrogacy generally refers to a surrogacy arrangement in which the parties work directly with attorneys to manage the legal aspects of the journey, rather than through a full- service matching agency. The process is focused on providing legal structure, risk management, and compliance throughout the surrogacy arrangement.

In a legally guided surrogacy arrangement, Gaydos Duffer, P.C.’s role may include:

Initial consultations and education regarding the surrogacy process.
Recommendation of fertility clinics and review of clinic documents.
Recommendation of escrow agency and review of retainer agreements
Advising clients regarding Texas surrogacy laws and court requirements.
Coordination with the hospital or birthing center to provide legal documents necessary for the birth certificate or so that Intended Parent(s) can make medical decisions for the child.
Recommendation of professionals to assist with passports and other travel documents for international intended parent(s).
Recommendation of insurance agents/brokers to review and obtain any necessary insurance policies.

Importantly, legally guided surrogacy does not mean the law firm acts as a matching agency. Intended parents and gestational carriers locate one another independently. Gaydos Duffer, P.C. then guides intended parent(s) through the legal and procedural aspects of the arrangement for an agreed fee.
